Property Policies and Terms of Service

Pacific Vacation Booking & Cancellation Policy

Payment Terms

Pacific Vacation requires payment at the time of booking. For bookings made within 90 days of arrival, full payment is required at the time of booking and is non-refundable. However, if you are booking 91 days or more in advance, your payment is divided into two installments:

  • 50% Booking Payment at the time of reservation (non-refundable)

  • Remaining 50% balance due 90 or 120 days before arrival as detailed below

Single Villa Cancellation Policy
  • The Booking Payment (50% at the time of reservation) is always non-refundable, regardless of when you cancel.

  • If you paid your rental in full at the time of booking, you can receive a 50% refund if you cancel at least 90 days before arrival.

  • Within 90 days of arrival, no refunds are given, regardless of how much you've paid.

 

The Estate (Both Villas) Cancellation Policy
  • The Booking Payment made at the time of reservation is non-refundable, no matter when you cancel.

  • If you paid your rental in full at the time of booking, you can receive a 50% refund if you cancel at least 180 days before arrival.

  • Within 120 days of arrival, no refunds are given, regardless of how much you've paid.

 

Postponing Travel Dates

If you need to postpone your travel, please adhere to the following guidelines:

  • Request Timing: Postponement requests with new travel dates must be submitted at least 120 days before your scheduled arrival.

  • How to Request: Email your postponement request to info@staypv.com.

  • Payment: Your reservation must be paid in full before postponing.

  • Availability and Rates: New travel dates are subject to availability and possible rate increases.

  • Travel Period: Postponed travel must occur within 12 months of the original reservation.

  • Refund Policy: Opting to postpone your travel eliminates eligibility for a refund. Additionally, no refunds are provided for early departures, delayed arrivals, or if you reduce the number of nights reserved for any reason.

  • No-Shows: If you do not arrive as scheduled (no-show), the reservation is forfeited in full without refund.

Travel Insurance

To protect your travel investment, Cancel For Any Reason (CFAR) trip insurance is available for purchase at the time of booking.

Please note that travel insurance, damage protection, and any processing fees are non-refundable.

Pacific Vacation strongly recommends purchasing travel insurance to safeguard your trip. If our booking system did not offer you the option to purchase travel insurance—either due to timing restrictions (e.g., traveling within 30 days) or other factors—we suggest exploring coverage options and rates on Aardy.

Check-In & Check-Out Times

  • Check-In: 3:00 PM

  • Check-Out: 11:00 AM

These times are essential to allow our staff to complete thorough housekeeping and prepare the villa for the next guests. We kindly ask that you adhere to these times to ensure a seamless experience for all guests.

If you require an early check-in or late check-out, please contact us in advance. While we cannot guarantee availability, we will do our best to accommodate your request. Additional fees may apply.

Travel Service Disruption Disclaimer

At Pacific Vacation, we strive to provide exceptional service and accommodations. However, we acknowledge that travel and service disruptions may occur due to circumstances beyond our control.

 
Nonessential Travel

Vacations are considered nonessential travel and have long been subject to restrictions, recommendations, and advisories from both private and governmental agencies. These advisories may be issued for various reasons, including safety, health, and environmental concerns. Following the World Health Organization’s declaration of multiple variants as a global pandemic, the associated risks are now considered a known factor in travel. As such, the pandemic is not a valid reason for canceling a rental. Guests are strongly encouraged to purchase travel insurance to protect against unforeseen circumstances.Agencies that have historically issued such advisories include, but are not limited to:

  • United Nations

  • United States Department of State

  • Centers for Disease Control and Prevention (CDC)

  • Global Health Advisory

  • World Health Organization (WHO)

  • National Weather Service (NWS)

It is the responsibility of travelers to stay informed about any applicable travel advisories and restrictions that may impact their trip.

 

Travel Disruptions

Pacific Vacation is not responsible for delays, cancellations, or interruptions caused by:

  • Airline, ferry, or other transportation disruptions

  • Government-imposed travel restrictions, border closures, or advisories

  • Natural disasters, severe weather, or wildfire/smoke conditions

  • Civil or political unrest, strikes, or security threats

  • Epidemics, pandemics, quarantines, or public health advisories

  • Lost, stolen, or changes to visa or passport requirements that prevent travel

 

Catastrophic Events & Emergency Evacuations

In the event of a catastrophe—such as a hurricane, tornado, earthquake, flood, fire, wildfire, or any other situation beyond our control—that impacts the vacation rental, Pacific Vacation is not responsible for:

  • Securing alternate lodging for renters

  • Reimbursing financial losses related to transportation or alternative accommodations

 

No Compensation for Unforeseen Circumstances

Pacific Vacation does not provide refunds, credits, or compensation for disruptions caused by unforeseen events beyond our control. We strongly recommend purchasing comprehensive travel insurance to protect against unexpected changes or cancellations.

By confirming your reservation, you acknowledge and accept this Travel & Service Disruption Disclaimer as part of our booking terms and conditions.

 

Staff Policy

We kindly ask that all guests treat our staff with courtesy and respect throughout their stay.

Pacific Vacation has a zero-tolerance policy for any form of physical, verbal, or sexual assault or abuse toward staff members. 

 

Staff Roles & Access
  • Staff members are under the sole direction of Pacific Vacation management, not the guest.

  • Guests may not request or direct staff to perform duties outside their assigned responsibilities.

  • To ensure the highest level of service and property maintenance, staff members will have access to Pacific Vacation | StayPV Resort at any time during the guest’s stay.

 

Staff Tipping â€‹
  • Tips can be distributed at the end of the guest’s stay.

  • Individual tipping is preferred over a lump sum

  • Tips can be given in dollars or pesos.

Service Disruptions

Service Disruptions

While we strive to provide a seamless experience, Pacific Vacation cannot guarantee uninterrupted services, including but not limited to:

  • Power, water, internet, cable, or other utilities provided by local suppliers

  • Temporary closures or maintenance of resort amenities or nearby attractions

  • Noise or inconvenience due to construction, events, or local activities

  • Environmental factors or wildlife encounters

 
System Failures Policy

In the event of system failures—including A/C units, water, sewer, plumbing, electrical, gas, mechanical systems, appliances, ventilation, pool, hot tub, or other essential facilities—Pacific Vacation is not responsible for any resulting inconvenience or damages.

 

We will make every reasonable effort to repair or replace malfunctioning systems promptly. Guests must allow access for necessary inspections and repairs.

âš  System failures do not justify cancellation or refunds.

 
Maintenance & Reporting

Guests are responsible for the proper care of the rental property, including:

  • Landscaping, furniture, and furnishings

  • Appliances and mechanical systems

  • Electrical, gas, and plumbing fixtures

The property must remain clean and sanitary throughout the stay. Any issues or damages must be reported immediately.

 
Septic System Notice

Pacific Vacation operates on a septic system. To prevent damage:

  • Only flush toilet paper.

  • Do not flush baby wipes, feminine products, condoms, paper towels, or any non-biodegradable items.

  • Guests are responsible for any damages caused by improper use.

 
TV, Cable, Internet & Satellite

These services are offered as a courtesy and are not guaranteed.

  • No refunds or compensation will be issued for service disruptions, content availability, speed issues, or user-related difficulties.

  • We will attempt to troubleshoot internet issues but cannot guarantee resolution.

  • Guests are responsible for ensuring compliance with all copyright, trademark, and legal restrictions on accessed content.

 
Air Conditioning Policy
  • Keep doors and windows closed while A/C is in use to maintain efficiency.

  • A/C units in unoccupied rooms may be turned off by staff.

  • No exceptions.

 
Pool Policy
  • The pool area is not fenced or supervised—use at your own risk.

  • No lifeguards are on duty; adult supervision is required for children.

  • Unaccompanied children will be removed for safety. Staff will not supervise children.

  • Guests are responsible for any pool-related damages.

  • Do not introduce foreign substances (e.g., soap, shampoo, oils, glass, or metal). Cleaning/repair fees will apply for misuse.

 

GUEST Policies RESPONSIBILITIES

Insurance Policy

Pacific Vacation’s insurance does not cover guest belongings or any damage caused by guests. We are not responsible for loss, theft, or damage to personal property during the rental period.

Guests are strongly encouraged to carry personal insurance to cover their belongings and any potential damages from fire, water, theft, or unforeseen events. Safes are provided in all rooms at no charge for securing valuables.

 
Lost & Left Items Policy

Guests are responsible for shipping costs if they request the return of lost and found items. Due to international duties, import fees, and tariffs, we cannot guarantee import clearance for returned items in foreign countries. Items not claimed within 30 days will be donated to charity.

 
Handicap Accessibility Policy

Pacific Vacation | StayPV Resort is a private home and is exempt from local and international accessibility laws. The property does not have elevators, as they were not permitted at the time of construction. Its multi-level design, including stairs and narrow passages, limits wheelchair accessibility. Guests should consider these factors before booking, as accessibility accommodations are not available.

 
Maximum Occupancy Policy

Pacific Vacation | StayPV Resort is exclusively for use as a private vacation rental. To ensure guest comfort, safety, and compliance with property regulations, the following occupancy limits apply:

  • Villa Bahia: Up to 8 guests

  • Villa Encantada: Up to 10 guests

  • Entire Estate (Both Villas): Up to 18 guests total

At no time may the number of guests exceed these limits during the rental period. Per local occupancy regulations, Pacific Vacation enforces a maximum of 2 people per bedroom, regardless of age.

 
No Outside Visitors Policy

To maintain privacy, security, and the integrity of the guest experience, outside visitors who are not listed on the reservation are strictly prohibited from entering the property. Any unauthorized guests may result in immediate eviction.

 
Pets & Animals Policy

All pets, emotional support animals, and service animals are strictly prohibited—no exceptions. Mexico does not have laws requiring service animal accessibility in private homes.

If an animal is found on the premises:

  • It will be removed and boarded at a local shelter or veterinarian’s office at the guest’s expense.

  • The guest is fully responsible for any damages caused by the animal, including but not limited to:

    • Animal allergen remediation

    • Flea remediation

    • Any additional costs incurred for relocating or compensating future guests due to necessary remediation

âš  Guests who refuse to relocate the animal will be evicted immediately.

 
No Illegal Substances & Smoking Policy

The possession, use, or distribution of any illegal substances is strictly prohibited on the premises. This includes but is not limited to:

  • Drugs and controlled substances in violation of Mexican law

  • Minors possessing or consuming alcoholic beverages

Additionally, Mexico enforces a strict public smoking ban, including the prohibition of smoking in most public places, beaches, and certain outdoor areas. Guests must comply with all local smoking regulations.

âš  Any violation of this policy may result possible legal consequences under Mexican law.

 
Events & Parties Policy

Pacific Vacation | StayPV Resort does not allow weddings, receptions, parties, or large gatherings that include outside guests.

âš  Unauthorized events may result in immediate eviction and additional fees for damages or violations of this policy.

 
Filming & Photoshoots Policy

Filming or photography that involves more than two people, specialized equipment, or a crew is strictly prohibited at Pacific Vacation | StayPV Resort.

Additionally, castings, interviews, and photoshoots are not allowed on the premises.

Guests agree not to use the premises for any commercial activities or any purpose that violates criminal law or governmental regulations.

 
Transient Occupancy Policy

This rental agreement is strictly for short-term vacation use. Guests may not establish residency or extend their stay beyond the agreed rental period. Any attempt to claim residency or remain beyond the rental term is a violation of this agreement and may result in immediate eviction.

 
Mail & Package Delivery Policy

Pacific Vacation | StayPV Resort does not accept or hold mail or packages on behalf of guests. Mail and third-party deliveries (e.g., Amazon) are strictly prohibited. Guests should make alternate arrangements for receiving deliveries during their stay.

LEGAL DISCLAIMERS

Chargebacks Policy

A chargeback initiated for a valid credit card transaction will be considered theft of services and may result in legal action.

Chargeback policies apply to all bookings and purchases made through StayPV.com and third-party platforms. Guests are responsible for ensuring they understand and comply with the payment terms before initiating a dispute.

 
Breach of Terms

Any violation of the rental agreement will result in immediate termination of the Guest’s stay.

  • The Guest will be required to vacate Pacific Vacation | StayPV Resort immediately.

  • The Guest will forfeit the entire rental fee and security deposit.

 
Mediation Policy

In the event of a dispute concerning the interpretation or enforcement of this Agreement, both parties agree to binding mediation.

  • Mediation will be conducted by a certified mediator in Irving, Dallas County, Texas.

  • The non-prevailing party will be responsible for all mediation fees, including any necessary travel costs.

 
Hold Harmless Agreement

The Guest agrees to hold harmless and indemnify Pacific Vacation | StayPV Resort, StayPV.com, and their owners, employees, and affiliates from any loss, damage, expense, or liability, including but not limited to:

  • Personal injury or property damage affecting the Guest, rental occupants, or any minor children under their care.

  • Acts, omissions, or negligence by Pacific Vacation | StayPV Resort’s employees, owners, or any animals on the property.

This indemnification applies regardless of the cause of injury or damage and extends to all claims arising from the Guest’s stay.

ELECTRONIC CONSENT: All bookings using online third-party booking platforms and direct booking on StayPV.com the Guest agrees "I acknowledge, and I have read and accepted the Property Policies and Terms of Service contained above." Guest is consenting to use an electronic signature instead of an original signature on paper by signing below or booking online both directly at StayPV.com or a third-party booking platform. The Guest has the right to request to sign a paper copy instead.
